The victim, a 27-year-old Worcester resident, was on his way to work when he found himself stuck behind a red Honda Civic that was driving slowly. Frustrated by the slow pace, the victim attempted to pass the vehicle, setting off a chain of events that would leave him fearing for his life.

As the victim tried to overtake the Honda Civic, the driver of the other vehicle reacted aggressively. "He come from the back and he shoot and he tried to run away," the victim recounted to WBZ-TV. The victim, who initially thought the assailant was wielding a handgun, was left in a state of shock and disbelief.

The victim's passenger-side window was shattered, leaving him and his passenger covered in broken glass. "I told the police officer that I saw the gun and I saw him. He's, like, dark-skinned person," the victim said, providing a description of the alleged shooter.

The Aftermath: A Shaken Victim and a Suspect Arrested

Despite the terrifying ordeal, the victim's quick thinking and cooperation with authorities led to the arrest of the suspected shooter, 39-year-old Daniel Ochoa. Ochoa, who was apprehended while working as a roofer, pleaded not guilty in Worcester District Court.

The prosecutor revealed that the "gun" used in the incident was actually a pellet gun, not a handgun as the victim had initially believed. "They were able to recover what was a pellet gun immediately in a barrel next to the Honda Civic that was parked and operated by the defendant," the prosecutor told the judge.

Ochoa's lawyer acknowledged the damage to the victim's vehicle but emphasized that "it's not a handgun, nobody got hurt, thankfully." The judge set Ochoa's bail at ,000 cash and ordered him to stay away from the victim and refrain from possessing any weapons.

The victim, though shaken by the experience, has a message for Ochoa and others who may be tempted to resort to violence on the road. "Relax. Don't do this, it's not worth it to do all this stuff," the victim pleaded.
